Quando l’avvocato fa il giudice: 40 giorni e scatta il pignoramento?
Sul tavolo del Senato il DDL S.978 introduce l’intimazione di pagamento dell’avvocato: 40 giorni per pagare o opporsi, poi l’atto diventa titolo esecutivo. Qui trovi cosa è certo, cosa è ancora in discussione e come tutelarti.

Come funzionerebbe
L’avvocato del creditore emette un’intimazione di pagamento con documenti giustificativi. Nell’atto è indicato che entro 40 giorni il debitore può pagare oppure presentare opposizione al giudice di pace; in mancanza, l’intimazione acquista efficacia di titolo esecutivo e si può procedere a pignoramento.

La riforma vuole snellire un sistema ingolfato. Ma la scorciatoia non può diventare autostrada privata. Un controllo terzo — visibile, verificabile — è il prezzo minimo della fiducia pubblica. Accelerare sì; oscurare no. Le democrazie si misurano su come trattano chi è in difficoltà: non solo sulla rapidità dei pignoramenti.
Se ricevi un’“intimazione di pagamento”
- Non ignorarla: i 40 giorni decorrono dalla notifica.
- Conserva busta, ricevute e allegati; annota la data.
- Contatta subito un avvocato o un’associazione consumatori.
- Valuta l’opposizione al giudice di pace se il credito è contestabile.
