Percorso di tutela dei Cittadini assistiti dall’ASL TO4 nell’ambito del rispetto dei tempi di attesa per le prestazioni specialistiche ambulatoriali, ai sensi dell’articolo 3 del Decreto Legislativo 124/1998, in coerenza con le disposizioni nazionali e regionali
Il percorso di tutela fa riferimento alle visite/prestazioni comprese nel PNGLA (Piano Nazionale Governo Liste di Attesa) con specifico riguardo alla tipologia di “primo accesso”, posto che per le prestazioni in tipologia di accesso successivo al primo sarà di competenza dell’Azienda provvedere alle relative prenotazioni nell’ambito del percorso di presa in carico del paziente.
Il sistema di prenotazione regionale per visite ed esami segue i seguenti criteri:
1. ricerca del primo posto disponibile presso le strutture pubbliche dell’A.S.L. di residenza del richiedente;
2. ricerca di disponibilità alternative presso i privati accreditati dell’A.S.L. di appartenenza;
3. ricerca di disponibilità alternative in zone limitrofe (aree omogenee, cosiddetti bacini di garanzia);
4. ricerca di disponibilità alternative nell’intero territorio regionale.
Qualora l’utente rifiuti la prima data utile proposta, le cui tempistiche di erogazione rispettino i tempi massimi previsti, viene meno il relativo ambito di garanzia della Classe di priorità assegnata.
Al termine della ricerca sopra indicata, il Cittadino assistito dall’ASL TO4, in possesso di una prescrizione di visita e/o esame specialistico in classe di priorità B (entro 10 giorni) / D (entro 30 giorni per le visite e 60 per gli esami) / P (entro 120 giorni) che non sia riuscito a prenotare la prestazione sanitaria all’interno dei canali istituzionali e nei limiti delle tempistiche di erogazione indicate dai codici di priorità, potrà presentare formale istanza inviando una e-mail alla casella di riferimento.
• modulo di istanza compilato e firmato
• copia della prescrizione medica
• informativa sul trattamento dei dati personali degli utenti/pazienti datata e firmata
• copia del documento di identità in corso di validità
• copia della tessera sanitaria in corso di validità
• eventuale copia del promemoria di prenotazione.
L’ASL, a seguito della disamina della documentazione sopra indicata, dovrà in ogni caso effettuare un’ulteriore ricerca di disponibilità presso il CUP Regionale unitamente a un’attività di controllo in materia di appropriatezza prescrittiva.
Si rammenta che in nessun caso può essere autorizzato e, di conseguenza, riconosciuto il rimborso dei costi sostenuti in ordine alle visite ed esami eseguiti privatamente dall’interessato, in contrasto con la normativa e le disposizioni regionali

Il “percorso di tutela del cittadino”, previsto dall’art. 3 del D.Lgs. 124/1998, è uno strumento che consente ai cittadini di ottenere prestazioni sanitarie nei tempi massimi stabiliti. Se tali tempi non vengono rispettati, il cittadino ha diritto a ricevere la prestazione in regime intramoenia o presso strutture private convenzionate, senza costi aggiuntivi rispetto al ticket.
Tuttavia, l’applicazione di questo percorso varia tra le diverse Regioni italiane. Alcune Regioni hanno implementato procedure chiare e accessibili, mentre altre presentano informazioni frammentate o difficili da reperire.
